2. Partner Visa Subclass 801 - Permanent
For those in a sincere and enduring relationship with an Australian citizen, permanent resident, or qualified New Zealand citizen, the Partner Visa Subclass 801 is a residency permit. Those who have previously been given a temporary partner visa under class 820 and have satisfied the requirements for permanent residency are eligible to apply for this visa.
Must cover the following requirements:-
- Be in a genuine and ongoing relationship with an Australian citizen, permanent resident or eligible New Zealand citizen
- Be in Australia at the time of application.
- Have held a temporary Partner Visa Subclass 820 for at least two years.
- Meet the necessary health and character requirements.
- Provide evidence of functional English proficiency, unless exempt.
3. Partner Visa Subclass 309 - Provisional
The spouse or de facto partner of an Australian citizen, permanent resident, or qualified New Zealand citizen may live and work in Australia for up to two years with the help of the Partner visa subclass 309. The application process for a permanent Partner visa subclass 100 begins with this visa.
The applicant must be in a sincere and ongoing relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen in order to qualify for a Partner visa subclass 309. Additionally, the applicant must meet the Australian government’s standards for morality and physical fitness.
A thorough application form must be submitted along with supporting materials such proof of the partnership, character and health certificates, and financial documentation when applying for a Partner visa under subclass 309. The application must also show that the sponsor is a qualifying citizen of New Zealand, Australia, or a permanent resident of those nations.

You must be in a sincere and ongoing relationship with your partner, who must also sponsor you, in order to qualify for the Subclass 100 visa. Additionally, there are certain character and health criteria for both you and your mate.
Typically, the Subclass 100 visa is issued in two phases. First, you’ll receive a temporary visa (Subclass 309) that will let you and your partner stay in Australia for up to two years. If your relationship is still sincere and continuous after this time, you can qualify for the permanent Subclass 100 visa.
